CALL TO ORDER: Regular Business Meeting

Mayor Don Kirby called to order the Regular Business Meeting for the Union City Commission on Monday, April 13, 2009 at 7:00 p.m.

 

Present: Mayor Don Kirby, City Commissioners Bob Kelly, Todd Sayers, John Adams, and John Mefford.  Also Barry Burke, (FOPPE Technical Group), City Attorney Greg Voss and Warren Moore (City Administrator), Kathy Porter (City Clerk/Treasurer). There were two (2) in audience attendance: Karen Franxman (resident) and Paul McKibben (reporter).

 

MINUTES: (All Commissioners were provided a copy prior to tonight’s meeting)

Commissioner Mefford moved to accept the REGULAR BUSINESS MEETING MINUTES of Monday, March 9, 2009 and the motion was seconded by Commissioner Kelly.  Motion carried. 

 

TREASURER’S REPORT: Commissioner Adams moved to accept the Treasurer’s Report as of March 31, 2009 as presented.  Commissioner Sayers seconded the motion.  Motion carried

 

CORRESPONDENCE:   Letter dated March 13, 2009 from Kevin P. Costello, Executive Director from Boone County Planning Commission regarding Board of Adjustments.  The letter states there is a vacancy on the Union Board of Adjustments.  According to K.R.S. 100.217(5), “vacancies on the Board of Adjustments shall be filled within sixty (60) days by the appropriate appointing authority.  If the authority fails to act within that time, the Planning Commission shall fill the vacancy.  When a vacancy occurs other than through the expiration of the term of office, it shall be filled for the remainder of that term.”  The Planning Commission has two options.  Advertise the opening and then select an appropriate candidate or they can review a recommendation made by the City of Union.  Mayor Kirby asked if there are any recommendations for appointment of this position.  Mr. Mefford asked two of his neighbors and Mr. Moore stated he had persons interested but they lived outside the city limits.  The Mayor stated that he would contact Mr. Costello and let him know the best option is to provide a recommendation.  Mr. Voss stated it does not have to be a resident of Union.  Mr. Mefford asked for a brief description of the position, and Mr. Moore explained that anytime there is adjustment necessary for zoning issues it comes before the Board of Adjustments.

CITY ADMINISTRATOR’S REPORT:  Warren Moore – City Administrator

Mr. Moore stated that he sold the radio tower from the Old Fire House for $400.00. Union Town Plan – Pizzuti will be here April 16th at 1:30 p.m. to provide the draft report.  The meeting will be held in Mayor Kirby’s office.   Sanitary Sewers, work has begun again, but also getting complaints from residents. We received deeds today for north, south ends of the city and Old Union Road.  We may get money back from the Disaster Relief, Mark Ihrig, Boone County Emergency Services, will act of the city’s behalf in collecting funds. 

 

COMMISSIONER OF PUBLIC WORKS/UNION VISIONING COMMITTEE: Bob Kelly-Commissioner of Public Works.  Mr. Kelly discussed the bids received on mowing/trimming and landscaping.  A&A Landscaping bid was $36,675.00 and Spillman Lawncare $72,000.00.  Mr. Kelly and Mr. Sayers presented information on both companies.  The city of Union will accept A&A Landscaping bid.  Mr. Sayers suggested we write a one year contract to protect the city’s interests in the event the services are not satisfactory.  A&A Landscaping claims “cost control and experience” in it’s considerably lower bid.  After discussion, Mr. Kelly made a motion to accept the bid from A&A Lawn Care Services and the motion was seconded by Mr. Sayers.  Motion carried. 

Mr. Kelly stated that street lights are up in Harmony Subdivision.  Hempsteade roads need repairs before the scheduled dates.  Many complaints have been made regarding pot holes and concrete/debris on roadways in the city. Mr. Kirby asked if the street cleaners would pick up the debris.  Mr. Burke stated he believed hot/cold patch work would be done this month; he will relay this information to Pete Michels Construction.  Mr. Kirby stated the work needs to be done as soon as possible.  Pizutti will be here on Thursday, April 16th to review task one, residential/commercial assessment.

PLANNING & ZONING:  Jim Longano - Planning and Zoning Union Representative

Mr. Longano submitted the summary of April 1st Planning Commission Meeting.  There was nothing in the report that pertains to the city of Union.

 

CITY ENGINEER REPORT: Mr. Barry Burke with Foppe Technical Group presented the City Engineer’s Report.  (All Commissioners were provided copies prior to the meeting)  Phase C is 86% done, except for restoration.  Phase A&B are 5% complete. Both phases together are approximately 42% complete.  Work on Old Union and Mt. Zion roads will be lengthy.   Mr. Richard Hanser, of 10398 Russwill Drive, made a complaint about driveway settlement.     Ferguson, relocation public sewer for easement was denied.  Gray property transfer is still pending.  Fairfield Food Mart owner concerned about location of the sewer and gas tank.  Field survey and construction started north of SR536 during the first week of March.  Mr. Burke indicated he contacted Spillman regarding large enclosure grate inlet along Hempsteade Boulevard.  The debris has reached 50% and Spillman is locked into a $5,000.00 fee to clean it up.  He will do more excavation down to the flow line.  Pete Michels will develop a speed bump “template” for the city and make it right before payment is made.  Storm drainage discharge debris complaint made by Mr. Bowman.  The city has no responsibility regarding this complaint.  Mr. Stuckwisch of 10212 Lurawoods Drive has a fence and structure that will need to be removed from his property.  Mr. Foster, Foppe Group, submitted a summary of his meeting with Boone County Conservation District.  Mr. Burke submitted a “draft” plan sheet containing work to be done in Hempsteade where concrete/asphalt meets to clean out expansion joints, milling off bumps, adding four new catch basins.  Legal Notice for bidding on this job will appear in the Boone County Recorder.  Bids will be accepted on May 6th, later changed to May 27th, and Mr. Burke will make recommendations at the May 11th meeting, later changed to June 8th.  The goal is to begin work on this project in May.       

 

OLD BUSINESS:

There was no old business to discuss.

 

NEW BUSINESS:

Mr. Mefford discussed the receipt of fifteen (15) resumes for the position of Events Coordinator; of which three were selected for interviews.  Mr. Mefford and Mr. Adams held these interviews and asked the same questions of each candidate.  Mayor Kirby and Mr. Kelly discussed the amount to be paid for this position, which was agreed upon, at $15,000.00.  Mr. Mefford stated there would not be a “set” number of hours for this position.  Mr. Adams asked that the resumes of the other two candidates be kept on file for possible future projects or work.  The candidates agreed.  

 

RESOLUTION No. 2009-003 – RESOLUTION APPOINTING KAREN FRANXMAN TO THE POSITION OF EVENTS COORDINATOR FOR THE CITY OF UNION, KENTUCKY.  Commissioner Adams made a motion to accept, Commissioner Mefford Seconded. Motion carried.

 

RESOLUTION No. 2009-004 – RESOLUTION OF THE CITY OF UNION, KENTUCKY AUTHORIZING MARK IHRIG, BOONE COUNTY EMERGENCY SERVICES TO EXECUTE FOR AND IN BEHALF OF THE CITY OF UNION, KENTUCKY FOR THE PURPOSE OF OBTAINING CERTAIN FEDERAL FINANCIAL ASSISTANCE UNDER THE DISASTER RELIEF ACT OR OTHERWISE AVAILABLE FROM THE PRESIDENT’S DISASTER RELIEF FUND.  Commissioner Sayers made a motion to accept, Commissioner Mefford seconded.  Motion carried.

Next City Commission Meeting: Monday, May 11, 2009 @ 7:00 p.m.

 

ADJOURNMENT:

No further business came before the Commission. Commissioner Kelly moved to adjourn the meeting at 8:20 p.m. Commissioner Sayers seconded the motion. Motion carried.
