ORDINANCE FOR CITY OF UNION, KENTUCKY

 ORDINANCE NO. 2026-09

AN ORDINANCE RENEWING THE FRANCHISE AGREEMENT WITH DUKE ENERGY THAT WAS ESTABLISHED BY CITY OF UNION ORDINANCE NO. 2023-09

WHEREAS, the City of Union, Kentucky has entered into a franchise agreement with Duke Energy and that said franchise agreement was established in and/or by the City of Union, Kentucky Ordinance No. 2023-09;

WHEREAS, the City of Union, Kentucky and Duke Energy entered into the Franchise Agreement and that said agreement is dated October 20, 2023’

WHEREAS, Duke Energy has provided satisfactory services to the residents of the City and has complied with all requirements under the agreement;

WHEREAS, Section 3.7 of Ordinance No. 2023-09 permits the parties to renew the franchise agreement for two (2) additional three (3) year periods;

WHEREAS, the City of Union, Kentucky and Duke Energy have reached an agreement to extend the franchise agreement for an additional three (3) years (Please see the agreement referenced herein attached hereto as Exhibit “A.”);

NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF UNION, KENTUCKY, AS FOLLOWS:

Section 1.0

That the City of Union, Kentucky hereby accepts the three (3) year Franchise Agreement with Duke Energy referenced in Exhibit “A” that is attached hereto.

Section 2.0

The Union City Commission hereby authorizes the Mayor, Larry K. Solomon to enter into said agreement with Duke Energy.

Section 3.0 – Construction

            This Ordinance shall not be construed in a manner which would create an obligation, requirement or duty on the party of the Franchisee which in any way inconsistent with Kentucky law or its tariff on file with and approved by the Commission.

Section 4.0 – Provisions Severable

The provisions of this ordinance are severable; and the invalidity of any provision of this ordinance shall not affect the validity of any other provisions thereof; and such other provisions shall remain in full force and effect as long as they remain valid in the absence of those provisions determined to be invalid.

Section 5.0 – Conflicting Ordinances Repealed

All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed to the extent of such conflict.

Section 6.0 – Effective Date

This ordinance shall be effective as soon as possible according to law.

Section 7.0 – Publication

This ordinance shall be published in summary pursuant to KRS 83A.060.
